Terms and Conditions

1. Introduction

Welcome to Portsmouth Coach Company. These Terms and Conditions govern your use of our services and website. By using our services, you agree to comply with and be bound by these terms. Please read them carefully.

2. Definitions

  • “Company”: Refers to Portsmouth Coach Company.
  • “Client”: Refers to the individual or entity booking or using the Company’s services.
  • “Services”: Refers to the transportation services provided by the Company, including but not limited to coach and minibus hire, guided tours, and corporate travel.

3. Booking and Payment

  • Booking Confirmation: All bookings are subject to availability and will be confirmed in writing by the Company.
  • Payment Terms: A deposit may be required at the time of booking, with the balance payable prior to the service date. Payment methods include credit/debit card, bank transfer, or other methods as agreed.
  • Cancellation Policy: Cancellations must be made in writing. Cancellation fees may apply as follows:
    • More than 30 days before the service: No charge.
    • 15-30 days before the service: 50% of the total fee.
    • Less than 15 days before the service: 100% of the total fee.

4. Client Responsibilities

  • Accurate Information: The Client must provide accurate information when making a booking. Any changes to the booking details must be communicated promptly.
  • Conduct: Clients are expected to behave in a respectful and safe manner. The Company reserves the right to refuse service to anyone who poses a risk to safety or behaves inappropriately.
  • Damage and Liability: The Client is responsible for any damage caused to the vehicle or property during the hire period. The Company reserves the right to charge for any repairs or cleaning required.

5. Company’s Responsibilities

  • Service Delivery: The Company will endeavor to provide the services as described in the booking confirmation. However, the Company reserves the right to make minor changes if necessary.
  • Safety and Maintenance: All vehicles are regularly maintained and safety-checked. The Company ensures that all drivers are fully licensed and trained.
  • Insurance: The Company holds comprehensive insurance coverage, including public liability insurance. However, personal belongings and luggage are carried at the Client’s own risk.

6. Limitations of Liability

  • Force Majeure: The Company is not liable for any failure to perform due to circumstances beyond its control, including but not limited to natural disasters, accidents, or government actions.
  • Indirect Losses: The Company is not liable for any indirect or consequential losses, including loss of profit, business, or goodwill.
  • Maximum Liability: The Company’s maximum liability for any claim arising out of or in connection with the services provided is limited to the total fee paid by the Client.

7. Complaints and Dispute Resolution

  • Complaints: Any complaints must be submitted in writing to the Company within 14 days of the service date. The Company will investigate and respond within a reasonable timeframe.
  • Dispute Resolution: Any disputes arising out of or in connection with these terms will be resolved through negotiation. If unresolved, the dispute may be referred to mediation or arbitration.

8. Privacy and Data Protection

  • Data Collection: The Company collects personal data necessary for booking and providing services. This includes names, contact details, and payment information.
  • Data Use: Personal data is used solely for the purpose of delivering services and will not be shared with third parties without consent, except as required by law.
  • Data Security: The Company takes appropriate measures to protect personal data against unauthorized access, alteration, disclosure, or destruction.

9. Changes to Terms and Conditions

The Company reserves the right to amend these Terms and Conditions at any time. Any changes will be posted on the Company’s website and will take effect immediately upon posting.

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
